SCOPE

Article 1 - Scope

The terms and conditions described below apply to all orders placed on 'Lonyca.com' website and for all items offered on the 'Lonyca.com' website by non-commercial individuals.

Consequently, any order placed on the 'Lonyca.com' site implies the buyer's unreserved acceptance of these terms and conditions, of which the customer acknowledges and attests to having read before ordering.

"LONYCA BIJOUX" reserves the right to amend the provisions described below at any time. If applicable, the applicable conditions are those in force at the date of registration of the order.

Article 2 - Presentation of products

The essential characteristics of the products offered for sale are clearly indicated in each product sheet on our website.

The photographs on each product sheet are conform to the products but are only used for indicative and illustrative purposes and therefore cannot enter into the contractual field. The liability of "LONYCA BIJOUX" cannot be engaged if errors are introduced there.

"LONYCA BIJOUX" strives, as far as possible, to ensure the most faithful possible photographic representation of the products. However, any variation between the photographs and the real object cannot engage the contractual responsibility of "LONYCA BIJOUX".

Article 3- Period of validity of offers to sell

All products for sale on the Lonyca.com are offered for sale while stocks last. The availability of each product is displayed on the site alongside each product sheet.

In the event that a product is sold out, the stock status will be clearly indicated on the product sheet.

In the event that a product becomes unavailable after the order, "LONYCA BIJOUX" will inform you by email of this unavailability as soon as possible.

Product prices

4.1 Product prices

The prices of the products sold on ‘Lonyca.com’ are those in effect on the day the order is placed. They are denominated in pounds sterling and calculated all taxes included. They will be increased by the shipping costs applicable on the day of the order as well as any special services.

The prices do not take into account French / British VAT because "LONYCA BIJOUX" is represented by Marine Serena who acts as a sole trader and is not subject to the VAT regime.

4.2 Customs duties

Customs duty can be be payable for delivery within the European Union. In the event of delivery outside the European Union, any customs taxes for the importation of the products ordered are excluded from the price. To know the possible customs duties and applicable taxes, it is up to the customer to inquire with the competent authorities of his country.

Article 5 - Registration of orders

Any order implies acceptance of the prices and description of the products available for sale.

After placing your order, an order confirmation email including the summary and confirmation of entry into production will be sent to the email address entered when placing the order after 1 to 6 working days.

Please ensure the accuracy of the personal data entered for shipping purposes (address, last name, first name etc.). LONYCA BIJOUX cannot be held responsible for the failure to receive an order in the event that the customer's personal information has not been correctly entered when placing the order.

Article 6 - Terms of payment

Payment for orders placed on Lonyca.com is made: by debit, credit card or Paypal account.

No other means of payment can be accepted (cash, checks).

In any event, LONYCA.BIJOUX reserves the right to refuse any order or delivery in the event of an existing dispute with the customer, total or partial non-payment of an order, payment by debit card refused or well for reasons other than LONYCA.BIJOUX will reserve the right to explain to its client. The responsibility of LONYCA.BIJOUX can in no case be engaged on this basis.

In order to ensure payment security, LONYCA.COM utilizes the secure payment service of Paypal and Square Paiement. Payment will be made on the Internet on LONYCA.COM by Credit Card (Visa, Mastercard, American Express, Maestro, Visa Electron or Vpay logo) or by the user's Paypal account for the Paypal account of lonyca.bijoux@gmail.com

The online supply of the credit card number as well as the final validation of the order will be worth proof of the entirety of the said order and will be worth due of the sums committed.

Article 7 - Withdrawal period

7.1 Right of withdrawal relating to non-personalized products

The Buyer has a period of fourteen days, from the receipt of the products, to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception, where applicable, of costs return and thirty days to make an exchange.

If the period of fourteen days expires on a Saturday, a Sunday or a public or non-working day, it is extended until the next working day.

Any returned product must be in its original condition and unworn, as well as in its original pouch to ensure its protection during transport. If the returned product is damaged, it will be returned to the Customer at his expense.

Failure to collect a package does not give rise to the right of withdrawal.

7.2 Exercising the right of withdrawal

Before the expiration of the withdrawal period, please contact Lonyca Bijoux at the following address contact@lonyca.com, expressing in writing your wish to retract.

7.3 Right of withdrawal relating to personalized products

All personalized jewelry cannot be exchanged or returned. Alll jewelry made according to the customer's specifications (size, pearl colors) or clearly personalized cannot give rise to the right of withdrawal.

Return costs remain the responsibility of the Customer.

Article 8 - Deliveries

For all the details relating to the delivery of your order, please refer to our 'Deliveries' section on LONYCA.COM.

In the event of delay in the delivery of the products, Lonyca will make sure to inform you as soon as possible and will endeavor to take the necessary steps to determine the cause inherent in the delay and to find an adequate solution. You can also notify us of the delay in delivery by sending us an email to contact@lonyca.com

An unclaimed package returned to our workshops will not be refunded.

Article 9 - Guarantees/Returns/Exchanges

All personalized jewelry (rings, necklaces) cannot be exchanged or refunded except in the event of a defect. All defective parts due to a manufacturing defect duly noted by our Customer Service gives the right to a right of return, exchange or refund.

To return a defective jewel, please send an e-mail to contact@lonyca.com and wait for a return authorization, describing precisely the defective aspect of the jewel and providing clear photos highlighting manufacturing defects. No exchange or refund can be made without an authorization having been previously submitted and duly accepted by Lonyca Bijoux.

After receiving the agreement to return the defective jewel, please return your jewel in its packaging, by post within a simple bubble envelope (international priority letter)  to the following address:

We will not be able to process the refund if:

1 - If the package is not returned EXACTLY as you received it (its Lonyca pouch is essential to protect it during transport)

2 - If you use a different shipping method than the one prescribed.

 

Defects resulting from accidents, or improper handling or use (such as shock, impact marks, crushing, exposure to corrosive agents), as well as the consequences of the acidity of the skin, wear and normal aging of the jewel will not be accepted as reasons for return.

Lonyca cannot be held liable for personal injury or other physical or material damage resulting from  improper use of all products sold on Lonyca.com, including gift packaging and other protective pouches.

Article 10 - Force majeure

LONYCA BIJOUX cannot be held responsible for the non-performance of one of its obligations arising from the sales contract as soon as this non-performance is linked to the occurrence of an event of force majeure.

Article 11 - Processing of personal data

LONYCA BIJOUX is responsible for processing your personal data. The personal information that you communicate to us as part of your orders is intended for LONYCA BIJOUX is necessary for the processing of your order and the monitoring of our commercial relationship.

We assure you in this regard that you have taken the necessary measures to legally supervise this transfer of data, in particular by completing the appropriate formalities with the ICO (Information Commissioner's Office).

In accordance with European Regulation No. 2016/679, known as the General Data Protection Regulation (GDPR), the buyer has rectification and erasure of personal data concerning him. He also benefits from the possibility of limiting or opposing the processing which concerns him with lonyca.com via the following address: contact@lonyca.com.

Article 12 - Competent courts

These General Conditions as well as the sale of LONYCA BIJOUX products are exclusively governed by British law. Any dispute relating to the interpretation and / or execution of these General Conditions will be in the absence of an amicable agreement of the exclusive competence of British courts.

Article 13 - Intellectual Property

Lonyca represented by Marine Serena is the owner of Lonyca.com. All of its content is the exclusive property of Marine Serena. All graphics, photographs, models, text and illustrations may not be reproduced or used without the express written consent of Lonyca. Any total or partial reproduction of the Lonyca catalog is strictly prohibited.
